WeyQi General Website Terms of Use

1. Introduction

These General Website Terms of Use (these "Terms") govern access to and use of the public WeyQi website, including its public pages, content, features, and related online materials made available by Indura Tech FZCO, operating WeyQi ("WeyQi," "we," "us," or "our") (the "Website").

By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Website.

5.4 Uses the Website for Improper Communications

To the fullest extent permitted by applicable law, WeyQi and its affiliates, shareholders, directors, officers, employees, agents, contractors, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, business opportunities, goodwill, anticipated savings, data, or use, arising out of or in connection with:

• any errors, omissions, interruptions, delays, or security incidents affecting the Website; or

To the fullest extent permitted by applicable law, the total aggregate liability of WeyQi and its affiliates, shareholders, directors, officers, employees, agents, contractors, licensors, and service providers arising out of or in connection with these Terms or the Website will not exceed AED 100.

Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by mandatory law.

16. Indemnity

You agree to defend, indemnify, and hold harmless WeyQi and its affiliates, shareholders, directors, officers, employees, agents, contractors, licensors, and service providers from and against any claims, demands, actions, proceedings, losses, liabilities, damages, judgments, settlements, penalties, fines, costs, and expenses, including reasonable legal fees, arising out of or relating to:

• your violation of any applicable law or rights of any person or entity; or
• any information, material, or Feedback you submit through or in connection with the Website.

This indemnity applies except to the extent a claim results from WeyQi's own final judicially determined fraud or willful misconduct.

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to conflict of laws principles.

You and WeyQi agree that the courts of Dubai, United Arab Emirates will have exclusive jurisdiction over any dispute, claim, or controversy arising out of or in connection with these Terms or the Website, except to the extent mandatory law requires otherwise.

20. No Waiver

No failure or delay by WeyQi in exercising any right, power, or remedy under these Terms will operate as a waiver of that right, power, or remedy, nor will any single or partial exercise of any right, power, or remedy preclude any other or further exercise of it.

21. Assignment

You may not assign or transfer these Terms without WeyQi's prior written consent. WeyQi may assign or transfer these Terms, in whole or in part, in connection with a corporate reorganization, merger, acquisition, sale of assets, or by operation of law.

22. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

23. Entire Agreement

These Terms constitute the entire agreement between you and WeyQi regarding your use of the Website, except where additional or separate terms expressly apply to specific services, accounts, programs, or interactions.
